Pop-Up Sports LLC Terms of Service

Effective Date: July 3, 2026 Welcome to Pop-Up Sports LLC! These Terms of Service (“Terms”) outline the terms and conditions for renting and using our mobile golf simulator services. By booking or using our services, you agree to be bound by these Terms.

1. Service Overview

Pop-Up Sports LLC provides mobile golf simulator rentals, including equipment setup, support, and related services (“Services”) for events such as corporate gatherings, private parties, birthday celebrations, bachelor/bachelorette parties, fundraisers, and more. Our Services are available within Charlotte, NC and surrounding areas within 50 miles.

2. Booking and Payment

2.1To secure a booking, a completed booking form and payment deposit are required. Bookings are confirmed upon receipt of payment and a signed rental agreement.

2.2 Payment Terms

Full payment is required at the time of booking to confirm your reservation. All payments are non-refundable except as outlined in our cancellation policy.

2.3 Cancellation Policy

Cancellations must be made at least 30 days before the event to qualify for a refund of the deposit. Cancellations made within 30 days of the event are non-refundable.

2.4 Travel Fees

A flat rate travel fee applies to events outside our immediate area. The travel fee will be clearly communicated at the time of booking.

3. Customer Responsibilities

3.1 Space Requirements

The customer is responsible for providing a suitable space for the simulator setup, approximately 15ft x 15ft minimum, with access to a standard power source within 100 feet.

3.2 Safety and Supervision

The customer is responsible for ensuring a safe environment for guests using the simulator. Children under the age of 13 must be supervised while using the equipment.

3.3 Loss or Damage

Any damage to equipment caused by customer negligence or misuse may result in additional charges for repair or replacement. The customer agrees to take reasonable care of all equipment provided by Pop-Up Sports LLC.

3.4 Indoor and Outdoor Events

Customers hosting outdoor events are responsible for ensuring the space is level, clear of debris, and suitable for simulator operation. Pop-Up Sports LLC reserves the right to cancel or relocate the setup if conditions are deemed unsafe.

4. Pop-Up Sports LLC Responsibilities

4.1 Setup and Takedown

Our team will handle all aspects of simulator setup before the event and takedown afterward. We aim to complete setup within 90 minutes and takedown within 45 minutes, ensuring minimal disruption to the event.

4.2 On-Site Support

During the event, our staff will be available to provide assistance and technical support. We aim to ensure a smooth and enjoyable experience for all guests.

4.3 Equipment Maintenance

Pop-Up Sports LLC will maintain the simulator and all other equipment in good working order. Should any technical issues arise, we will make reasonable efforts to resolve them promptly.

5. Limitation of Liability

To the extent permitted by law, Pop-Up Sports LLC is not liable for any injuries, damages, or losses arising from the use of our services or equipment. The customer assumes all risks related to the use of the simulator, including but not limited to risks associated with physical activity and simulator operation.

6. Intellectual Property

All content provided by Pop-Up Sports LLC, including logos, images, text, and software, is protected by intellectual property laws and is for use solely in connection with our services. Any unauthorized use or reproduction of our content is prohibited.

7. Privacy

Pop-Up Sports LLC respects the privacy of all customers. We collect and store personal information only for booking purposes and to improve our services. 8. Governing Law

These Terms of Service are governed by the laws of the State of North Carolina. Any disputes arising under or relating to these Terms will be resolved in the courts of North Carolina.

Pop-Up Sports LLC reserves the right to update or modify these Terms at any time. Any changes will be posted on our website, and continued use of our services following such updates signifies acceptance of the revised Terms.
